We take privacy and data security seriously and are committed to transparency in the collection and use of your Personal Information. We have prepared this Privacy Policy to help you understand how we collect and use your Personal Information, the choices you have for controlling your Personal Information and the circumstances under which we may share such information with others. This Privacy Policy forms part of the Terms of Use that govern your use of the Service.
This Privacy Policy (this “Policy”) applies to Personal Information collected about you through our brand websites and mobile applications (“platforms”), our salon technologies used at your favorite Regis affiliated salon, and our interactions with you through social media (collectively, the “Services”). This Policy does not cover the privacy practices of any of our brand franchisees outside of Regis’ approved systems. For more information about franchisees’ collection and use your Personal Information, contact your local salon.
Definitions
The term “Content” refers to all of the software and code comprising or used to operate the Service, and all of the text, photographs, images, illustrations, graphics, sound recordings, video and audio-video clips, and other materials available on the Service, including User Generated Content.
The term “Feedback” refers to the Content you post on or through the Service that is specifically about how we can improve the Service and the products and services we make available through the Service.
The term "Personal Information" means any information, in any form, about an identified or identifiable individual, including an individual whose identity may be inferred or determined from such information.
The term “User Generated Content” refers to all of the photographs, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions, or other content, any of which may include Personal Information you post (a) on or through the Service, or (b) on any social media platform (e.g., Instagram, Twitter, Facebook, Pinterest or Google+) with a hashtag that relates to one or more of our brands (e.g., #regisstyle), and that you give us permission to use. Examples of User Generated Content include comments posted to discussion boards and photographs you may post on the Service.

1. Personal Information We Collect and Use
Regis uses Personal Information it collects directly from you, automatically from your device, or from third party providers. Below we describe the Personal Information that we collect from the various sources and the purposes we use the data for. Please note, those laws that apply to the processing of Personal Information (including regulations, guidelines, government issued rules, and court opinions interpreting laws) (hereinafter collectively referred to as “data protection laws”) may require us to describe our processing using certain terms or in a specific way. Although we have tried to use terms consistent with data protection laws in the jurisdictions where we have salons or direct our Services, we aren’t always able to use terms that may be used in your jurisdiction. A. Information You Provide
Regis collects the Personal Information you provide directly to us when you use the Service.
· Account Registration and Login: When you register for an account, download one of our mobile applications (the “App”), and/or subscribe to our digital products, services, and loyalty and subscription programs, we may collect your name, gender identity, phone number, email address, password, communications preferences and other information you opt in to sharing with us, directly from you.
· Scheduling, Check Ins and Appointments: Where available, our Services may support scheduling, check ins and appointments through our platforms. In order to allow you to set appointments, check in for appointments, or for other appointment-related purposes, such as to send you reminders about upcoming appointments, we may collect name, email address, phone number, appointment information (location, stylist, services, service date, check in time, etc.) and communication preferences directly from you.
· Communicate and Respond to Inquiries: We may also collect any Personal Information you submit on or through the Service when you provide Feedback or contact us with questions. For example, we collect the Personal Information you provide when you review or comment on one of our products, or contact us with questions, which may include first and last name, email address, phone number, city, country, state/province, zip/postal code, inquiry and comments, directly from you.
· Contests, Giveaways and/ or Sweepstakes: When you enter contests you may be asked to provide your name, email address, mailing address and phone number so that we can reach you in the event you win a prize. Where applicable, we may also need to collect information necessary for us to report prize earnings for tax purposes to comply with law.
· Process Transactions: We may process transactions through our website, such as when you purchase a gift card. When you engage in a transaction through our website, we may collect Personal Information including the recipient name, recipient email, sender name, delivery date, sender email address, value, quantity, message, transaction details (card number, security code, and expiration date), billing address, and phone number directly from you.
· Marketing: The User Generated Content you submit on or through the Service is available to others who visit the Service. In addition, we may use User Generated Content you submit on or through the Service in advertising campaigns and other promotions. We may or may not use your name in connection with such use, and we may or may not seek your consent before using the content for such purposes. You should not submit any content you do not wish to make available to the general public, and you must take special care to make sure your submissions comply with our Terms of Use. In particular, your submissions must not violate the privacy or other rights of others.
· Improve our Services: When you participate in a survey or otherwise provide us with feedback, we may collect your survey responses (including your opinions), age, gender, and location information directly from you.
B. Information Collected by Third Parties
We collect Personal Information about you through third parties, including our franchise owners and service providers, for our legitimate business purposes, including:
· Process Transactions: We use a third party service provider to process transactions on our behalf and to manage our business and our transactions with customers. When you authorize a transaction, our service provider may share certain Personal Information about you with us, including, name, card type, transaction information (amount, ID, date/time, etc.), billing address, and billing zip code.
· Account Registration and Login: You may be able to choose to register, log-on, or enhance your profile on the Service through a third-party social media platform, such as Facebook Connect. By doing this, you are asking the third-party social media platform to send us registration information from your profile on that platform. By opting in to use your social media to register your account, you authorize that third party to provide certain information about you to us such as name and social media handle.
· Fulfill Transactions: In certain areas of the Service, users can submit information about other people. For example, if someone orders a gift or gift card or certificate online and wants us to send it directly to you, they must submit your name and email address. We use this information to send the gift to you.
· Safety and Security: We may collect Personal Information, such as IP addresses, email address, browser information and device information, to protect your information, and monitor the technical functioning and security of our platforms from third parties.
· Customer and Business Management. Our franchisees use approved third party Point of Sale (POS) systems, which allows them to make sales, accept payments, schedule customers, and for any transactions with our customers. We receive information from the POS systems to better understand our business. Information that we collect and use from our POS systems includes user ID, name, address, information about your customer record with us, email, phone number, information about your interactions with us, gender, date of birth, service preferences, referral information, information we can use to give you rewards or promotions (such as anniversary date), and your activity on our website or apps.
C. Information Collected Automatically
In addition to information that you provide to us, when you visit our platforms we may collect certain information using automated means, including:
· Operate the Service: We collect information automatically from your browser or device. This information typically includes your IP address, internet service provider, operating system, browser information, the date and time of your visit, device information and the pages you visit and actions you take on our Services.
· Marketing: We collect information automatically about your interactions with our Services and communications for marketing purposes, including your IDFA, IP address, location information, pages visited and actions taken when using our Services automatically from your device or browser. For more information see the Cookie Policy section below.
· Improve our Products and Services: To improve the content, functionality and usability of the Service, we may use web analytics services, to help us analyze how visitors use the Sites and how well our communications are working. These services track information about visitors including IP addresses, browser types, referring pages, pages visited, and time spent on particular pages, which we use to improve and tailor the user experience on our Sites. D. Other Purposes.
We may also use any of the Personal Information we listed above for the following purposes:
· To operate, evaluate, and improve our business, including improving and personalizing the experience for you and others;
· To maintain and improve our services, including to audit, research, and conduct analysis to protect people who use our platforms;
· For safety and security, by making sure third parties protect your information, and monitoring the technical functioning and security of our network;
· For legal and compliance, including complying with applicable laws, regulations, and legal obligations; and
· To protect the rights or property of Regis, its employees, its customers, and people who use its platforms.
2. How We Disclose Personal Information
We may share your Personal Information with third parties for our legitimate business purposes, including:
· Service Providers. Regis shares Personal Information collected through the Service with third-party service providers who act for or on behalf of Regis. For example, we may use third-party vendors to design, operate, and/or host the Service, to conduct surveys, to send emails and manage email campaigns, send push notifications through our App and to help us with our promotional efforts. These third parties may need information about you to perform their functions.
· Business Partners. From time to time, we may share your Personal Information with selected third party business partners (other than our service providers) who perform certain professional services. For example, we may share information about you to process payments, prevent fraud, or to perform audits. We may also may partner with joint marketing partners with whom we must disclose Personal Information to administer services. For example, we partner with third parties to sponsor contests or other promotions, and we may share with these third parties the Personal Information you submit to us to participate in the contest or take advantage of the promotion. Before doing so, however, we may offer you the opportunity to “opt in” as required by applicable law. In some cases, you will not be able to participate in a contest or take advantage of a promotion unless you consent to disclosure to our business partner of the Personal Information you submit in connection with the contest or promotion.
· Other Parties. We may share the information collected through the Service with our affiliates, manufacturers and licensors (collectively “Other Parties”). Our Other Parties may use the information in all the ways listed in this Policy, provided that such use relates to services authorized by Regis.
· Franchisees. Many of our stores are operated by our franchisees. We may choose to share information collected through the Service with our franchisees, and they may be permitted to use it for any purpose consistent with this Policy, or we may use the information collected on their behalf.
· With Your Consent. When you submit User Generated Content on or through the Service you are consenting to making such content available to others who visit the Service and for Regis to use the content for any purpose consistent with this Privacy Policy or any other notice provided at the time of your submission. Any Personal Information contained in User Generated Content you submit can be read, collected, or used by others. If we use your User Generated Content, we may or may not use your name in connection with such use, and we may or may not seek your consent before using the content for those purposes. You should not submit any content you do not wish to make available to the general public, and you must take special care to make sure your submissions comply with our Terms of Use. In particular, your submissions must not violate the privacy or other rights of others.
· To Comply with Laws and Protection of our Rights and the Rights of Others. We may disclose your Personal Information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. We may also disclose your Personal Information to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of the Service; to enforce or apply our Terms of Use or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others.
· Social Media Platforms. We may provide functionality on the Service that allows you to post information to a third-party social media platform (such as Facebook, Twitter, or Pinterest). If you choose to take advantage of this functionality, people with access to your profile on the third-party platform will be able to see your post. Further, if you choose to link your profile on the Service with an account on a third-party social media platform, we may share the information in your profile with that third-party platform. We may also use third-party social media platforms to offer you interest-based ads. To offer such ads, we may convert your email address into a unique value which can be matched by our partner company with a user on their platform. Although we do not provide any Personal Information to these platform vendors, they may gain insights about individuals who respond to the ads we serve.
· Ad Servers. Where permitted by law, and this Policy, we may share your personal data with our marketing and advertising partners, such as advertising, direct marketing, and lead generation providers, social media advertising partners, or other targeted advertising platforms.
SMS Originator Opt-in Data and Consent (US Residents): Regis does not sell or share mobile phone information with third-parties for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. 3. Cookie Policy
Like most companies, Regis uses cookies and/or similar technologies to collect information about a user’s use of our platforms automatically through the use of tracking technologies, such as cookies and pixels. Please note, we will refer to all tracking technologies as “cookies” throughout this policy. This section is meant to help you understand what tracking technologies Regis uses, the purposes for which we use tracking technologies, and the purposes for which we may allow third parties to place their tracking technologies on our platforms and when.
Cookies – a "cookie" is a small text file that websites send to your computer, device, or other internet-connected tool you are using that contains data used by the website for its business purposes. Cookies can be stored on your device for months, but you can choose to delete cookies stored on your device at any time through your browser settings.
Web Beacons – a "web beacon" or "pixel" is a tag used on a web browser or HTML email that records your activities when viewing the web page or email it is placed on. Regis uses web beacons to assist us in monitoring and improving our Services and communications. We may also allow some third parties to place web beacons on our platforms or in our communications. Because web beacons are imbedded in the platforms or communications, they are not stored on your device and will stop tracking you once you navigate away from our platforms.
A. How are Cookies Classified?
Cookies are classified by their purpose (their primary function on the website). We classify our third party cookies into the following categories:
Essential – These cookies are required for the website to function. You cannot disable these.
Targeted Advertising - Used to deliver advertising that is more relevant to you and your interests. May also be used to limit the number of times you see an advertisement and measure the effectiveness of advertising campaigns.
Personalization - Allow the website to remember choices you make (such as your username, language, or the region you are in) and provide enhanced, more personal features. For example, a website may provide you with local weather reports or traffic news by storing data about your general location.
Analytics - Help the us understand how its website performs, how visitors interact with the site, and whether there may be technical issues.
B. How Regis Uses Cookies
In general, we use tracking technologies to:
· Collect information about the ways visitors use the Service—which pages they visit, which links they use, and how long they stay on each page;
· Support the features and functionality of the Service—for example, to save you the trouble of reentering information already in our database or to prompt the settings you established on previous visits; and
· Personalize your experience when you use the Service—for example, serving relevant advertisements or re-targeting you via third party ad servers based on your interactions with us. For more information about the use of third-party cookies and advertising, see below.
· Save items in your cart—the Service uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS (if you have consented to receiving SMS messages).
The information we collect using these tracking technologies masks your identity. If, however, you have created a user account, we may link the information we collect using these web technologies to other information that identifies you personally.
Third Party Analytics Tools. Regis uses third party analytics tools to collect information about your usage of our platforms. This information is collected and provided to Regis in aggregate form only, meaning your information is combined with that of all other users and stripped of all identifiers in order to provide us with insights about how people find our platforms, how they use our platforms, and determine how effective our marketing is. Some third party analytics tools allow you to control your privacy preferences across all the websites by allowing you to download an extension for your browser to enable you to make global privacy choices with them. Regis may use the following analytics tools:
· Google’s Safeguarding your data
Third Party Ad Servers. Regis may choose to use other third party tracking technologies on its websites to either be able to re-target relevant advertising about our products or Services, or enable third parties to serve their ads and monitor users’ responses to their advertisements. These third party companies (“Ad Servers”) may re-direct you to other websites not associated with Regis. The use of Ad Servers may be considered a “sale” or “sharing” under certain data protection laws. Ad Servers have their own privacy practices, we do not control these third parties’ use of cookies or web beacons, or how they manage the information they gather through them. You should review the privacy policies of other websites you visit or link to from our website to understand how these other websites use cookies and how they use the information they collect through the use of cookies or web beacons on their own websites.
C. Blocking, Disabling, or Opting Out of Cookies
You may have choices about the collection of information by third parties cookies we use on the Service.
Browser Settings: Most browsers allow you to reject cookies by default. You may also be able to delete our cookies as soon as you leave the Service. Although you are not required to accept our cookies when you visit the Service, if you set your browser to reject cookies, you may not be able to use all of the features and functionality of the Service.
Google Ad On: For Google Analytics, you may download an Opt-out Browser Add-on. Please note that the Add-on does not prevent information from being sent to Regis. To learn more about the Add-on tool for Google Analytics, click here.
Subscribe to Opt-Out Lists: Some advertisers and service providers that perform advertising-related services for us and for third parties may participate in the self-regulatory programs. To learn more:

· Network Advertising Initiative (“NAI”), see http://www.networkadvertising.org/choices/.
Some of the third parties that collect interest-based information on the platforms do not participate in the industry-developed opt-out website, in which case the best way to avoid third-party tracking of your online behaviors may be through your browser settings and deletion of cookies.
Request to “Opt-Out Of The Sale Or Sharing Of Personal Information”: You can opt out of Targeted Marketing cookies or Third-Party cookies by submitting a privacy request through our Webform. Please note: we can only effectuate this for registered users, otherwise we cannot re-identify a cookie with a particular individual. If you are not a registered user, please choose one of the other methods described in this section. Note: when you choose to opt out of the sale or sharing of your Personal Information we will forward your request to the DAA and NAI.
Global Privacy Controls: Some browsers allow you to turn on Global Privacy Controls or Do Not Track signals (DNTs), which sends a signal to the websites you visit telling those sites that you do not wish to allow third-party cookies. There is no standard technology at this time for companies to receive these signals. Our websites do not currently consistently respond to DNTs received from web browsers.
4. De-Identified And Aggregate Information
We may de-identify and aggregate data for our business purposes, including but not limited to, to improve the products and features of our Services, to maintain the security and integrity of our systems, for analytics, and other legitimate business purposes. "De-identified data" means information that cannot reasonably be used to infer information about, or otherwise be linked to a particular data subject. Where we process de-identified data, we commit to maintain and use the information in de-identified form and not attempt to reidentify the information, except where permitted by law. We may disclose de-identified data to third parties who commit themselves to maintaining the de-identified data in de-identified form and not attempt to re-identify the data for any business purpose. We also may provide aggregate data to third parties. For example, we might inform third parties regarding the number of users of our website and the activities they conduct while on our website.
5. Legal Categories of Personal Information
Some laws require us to tell you about the Personal Information we collect about you in a certain way. Specifically, we are required to tell you about the "legal categories" of Personal Information defined by law. To make this easier to understand, we have bundled up the information we have provided to you a chart with the legal categories of Personal Information, examples of the types of Personal Information included in each legal category, the source(s) from which we collect your Personal Information, the purposes for which we collect your Personal Information, and the business purposes for which we share your Personal Information and with whom.
The Personal Information Privacy Chart is located at the end of this Policy, as well as a description of Personal Information we disclosed and sold or shared in the last twelve (12) months.
6. Your Rights and Choices
If you are a resident of a state with a consumer data protection law, you may have certain rights over how we use your Personal Information. We accommodate requests which meet legal and regulatory requirements and do not risk making our other data less secure or changing our other data. aYou may also designate an authorized agent to make a request on your behalf.
· Right to access — The right for a consumer to access from a business/data controller the information or categories of information collected about a consumer, the information or categories of information shared with third parties, or the specific third parties or categories of third parties to which the information was shared; or, some combination of similar information.
· Right to correct — The right for a consumer to request that incorrect or outdated Personal Information be corrected but not deleted.
· Right to delete — The right for a consumer to request deletion of Personal Information about the consumer under certain conditions.
· Right to opt out of targeted advertising — The right for a consumer to restrict a business’s ability to process certain types of Personal Information about the consumer, such as the right to opt out of sharing of Sensitive Personal Information or profiling, where applicable.
· Right to portability — The right for a consumer to request Personal Information about the consumer be disclosed in a common file format.
· Right to opt-out of sales or sharing — The right for a consumer to opt out of the sale of Personal Information about the consumer to third parties.
· Right to opt in for sensitive data processing — The right for a consumer to opt in before a business can process their sensitive personal information. Please note – we do not process sensitive personal information.
· Right against automated decision making — A prohibition against a business making decisions about a consumer based solely on an automated process without human input. We do not engage in automated decision making.
· Right to appeal — where a controller declines to take action regarding a consumer's request to exercise any privacy right, the controller must allow the consumer to appeal the decision and provide instructions on how they may request an appeal.
A. How to make a Request and What to Expect
You can submit a request to us via our Webform or any of the methods designated in the Contact Us section. We may ask for your name, phone number you use with us, email and the privacy right you would like to exercise when you make the request. Please note, if you use the telephone number, you will be guided through a process that will allow you to submit a verifiable request.
Responding to Requests
Your request will be evaluated to determine whether it meets the legal and regulatory requirements under applicable law, and does not risk compromising our other data or the Personal Information of other individuals. If we aren't able to fulfil any part of your request, we will let you know in our response, as well as the reason(s) we cannot do so.
Verification Process
In order to protect your information, we may need to confirm a requestor’s identity before responding to the request. You must log into your account (if you have one) or we will ask a few questions in order to confirm your identity. To complete the verification process you must log into your account and independently verify account access or correctly answer one or more questions to confirm identity. If we still cannot verify your identity as required by applicable law, we will let you know and may ask additional questions. Otherwise, we will acknowledge your request and contact you later with our full response.
Before sending a verification response, please double-check the email address. If you receive an email that appears to be from us but is not from our verification email address listed above, do not respond.
Any information we gather through this process will only be used for consumer verification, security procedures, or fraud-prevention. We will delete any verification information as soon as practical after processing your request.
Authorized Agents
You may designate an authorized agent to exercise your rights on your behalf. Authorized agents of consumers may make a request by using the methods in the Contact Us section of this Policy. Privacy laws require that any request you submit to us is subject to an identification and verification process, and confirmation of the agent’s authority, which may include attestation under penalty of perjury. Absent a power of attorney, we will also require the consumer to verify their own identity. We may verify identity based on matching information you provided with data we have maintained on you in our systems. This data could include, but is not limited to, email address, mailing address, or phone number.
What to do if you disagree with our decision
If we deny all or part of your privacy request, you may have a right to appeal that decision. If you would like to make an appeal, please contact us using the methods in the Contact Us section below, and include your name, email address, the type of request you made, and the reason for requesting an appeal. Please also reference your original request so we can better assist you.
B. Additional Rights for California Residents
California residents have the right to request certain details about how their Personal Information (as defined by California’s “Shine the Light” law) is shared with third parties and, in some cases, affiliates for direct marketing purposes. We may from time to time elect to share certain Personal Information about you with third parties for those third parties’ direct marketing purposes. If you are a California resident, you may obtain the categories of Personal Information shared and the names and addresses of third parties that received Personal Information for their direct marketing purposes during the preceding calendar year. You may make this request by writing to: Regis Corporation, 3701 Wayzata Boulevard, Suite 500, Minneapolis, MN 55416 (Attention: Department CS – Privacy Inquiry), or via email at privacyrequest@regiscorp.com. Any such request must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. To help us determine if this right applies to you, we may ask that you attest to the fact that you are a California resident and provide a current California address. Please note that we are only required to respond to one request per customer each year.
7. Steps We Take to Safeguard your Personal Information
We maintain reasonable administrative, physical and technological measures to protect the confidentiality and security of Personal Information you submit on or through the Service. Unfortunately, no website, server or database is completely secure or “hacker proof.” Likewise, although we use reasonable efforts to secure such information, transmission via the Internet is not completely secure, and we cannot guarantee the security of your information transmitted to us through the Service. We therefore cannot guarantee that your Personal Information will not be disclosed, misused or lost by accident or by the unauthorized acts of others. Further, we cannot control dissemination of Personal Information contained in User Generated Content you post on or through the Service, and you should have no expectation of privacy in such information.
8. Children’s Online Privacy
The Service is not intended for children or minors under the age of sixteen (16) years. If you believe that a child has submitted Personal Information on or through the Service without the consent and supervision of a parent or guardian, please contact us using the information provided in the Contact Us section so that we can take appropriate action. We do not knowingly sell or share (as those terms are defined under applicable law) the Policy of minors under the age of sixteen (16) years.
9. Information for Users Outside the United States
If you use the Service from outside the United States, please be aware that information we collect through the Service may be transferred to and stored on our servers in the United States. By using the Service, you acknowledge and consent to the transfer and processing of your personal data in the United States as described in this Privacy Policy. The data protection laws and regulations applicable to your Personal Information transferred to the United States may be different from the laws in your country of residence.
10. Personal Information Retention
We retain Personal Information pursuant to this Policy for the duration of our relationship with you, or for as long as necessary to fulfill the purposes for which we collected it, whichever is longer. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements for retaining Personal Information.
