READ THESE OFFICIAL RULES CAREFULLY BEFORE ENTERING. PARTICIPATION AND ENTRY CONSTITUTES AGREEMENT TO BE BOUND BY THESE OFFICIAL RULES. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION UNLESS YOU OPT-OUT. ARBITRATION IS MANDATORY AND THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS OTHERWISE SPECIFIED.

Sponsor’s computer is the official time keeping device for this Sweepstakes. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH TIKTOK, META, FACEBOOK, OR INSTAGRAM.
SPONSOR: The Supercuts Stylist Appreciation Sweepstakes (the “Sweepstakes”) is sponsored by Supercuts, Inc., 3701 Wayzata Blvd., Suite 600, Minneapolis, MN 55416 (“Sponsor” or “Supercuts”).
ELIGIBILITY: Open to U.S. legal residents located and residing in one of the 50 United States or District of Columbia, who are aged 18 or older (19 years of age in Alabama and Nebraska, 21 years of age in Mississippi), or the age of majority in the applicable jurisdiction at the time of entry, whichever is older. ONLY QUALIFIED STYLISTS WILL BE ELIGIBLE FOR ENTRY FOR THIS SWEEPSTAKES. A qualified stylist is an individual employee of a franchise of Sponsor (an “Entrant”). Supercuts may decide in its sole discretion whether an entry is eligible for participation in the Sweepstakes in accordance with these Official Rules. By participating, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Sweepstakes.
HOW TO ENTER: During the Entry Period, you may obtain entries into the Sweepstakes by satisfying any of the following and filling out this entry form HERE:

Ensure your Instagram account is publicly visible (i.e. is not set to a “Private Account” in Instagram’s settings);
Follow the Supercuts Instagram handle at @supercuts;
Locate the Instagram post by Supercuts promoting this Supercuts Stylist Appreciation Sweepstakes and like and comment on the post;
Complete the linked sign-up form; and
Tag Supercuts in at least one reel showcasing your before & after work and guests' experiences.
Ensure your Facebook account is publicly visible (i.e. is not set to a “Private Account” in Facebook’s settings);
Follow the Supercuts Facebook page at Supercuts;
Locate the Facebook post by Supercuts promoting this Supercuts Stylist Appreciation Sweepstakes and like and comment on the post;
Complete the linked sign-up form; and
Tag Supercuts in at least one reel showcasing your before & after work and guests' experiences.
TIKTOK
Ensure your TikTok account is publicly visible (i.e. is not set to a “Private Account” in TikTok’s settings);
Follow the Supercuts TikTok page at Supercuts;
Locate the TikTok video by Supercuts promoting this Supercuts Stylist Appreciation Sweepstakes and like and comment on the video;
Complete the linked sign-up form; and
Tag Supercuts in at least one post showcasing your before & after work and guests' experiences.
Entrant must include the following hashtag: #hairstylistappreciationdaysweepstakes.
The Entrant with the social media account associated with the above actions will receive one (1) entry into the Sweepstakes when all required actions are satisfied. You must provide all required information to be eligible to enter and win. Limit one (1) entry per person per social media account on each social media platform. An Entrant may obtain a total of three (3) entries by satisfying the entry criteria set forth for each and every platform as described above. By entering, you agree that Sponsor may contact you via social media, including on Facebook, Instagram or TikTok, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media page. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply.
By entering in this Sweepstakes, you signify and agree that your entry and any other materials submitted in connection with this Sweepstakes may be posted on Sponsor’s website and/or other social media sites or applications associated with the Sweepstakes in a manner that is consistent with these Official Rules.
By participating in this Sweepstakes, Entrant acknowledges and agrees that they will clearly and conspicuously disclose that he or she is participating in this Sweepstakes in the entry and any online social sharing interaction that references the Sweepstakes or that is used to obtain entries in connection with this Sweepstakes. At a minimum, the hashtag “[#hairstylistappreciationdaysweepstakes]” should be included in all social media communications sent pursuant to the Sweepstakes. Sponsor reserves the right in its sole discretion to disqualify any Entrant who does not adequately disclose his or her participation in this Sweepstakes while engaging in any online social sharing interaction. Entries, comments and content submitted or uploaded to any social media sites or other public sites in connection with this Sweepstakes (collectively, “Content Submissions”) may not contain, depict or show any content that: (i) is sexually explicit or suggestive, offensive, lewd, profane, obscene, or contains nudity or racist innuendo; (ii) promotes any activities that may appear unsafe or dangerous, or any political agenda or message; (iii) defames, misrepresents or contains disparaging remarks about Sponsor or other companies; (iv) contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) or copyrighted materials (including photographs, sculptures, paintings, and other works of art or images published via websites, television, movies or other media) owned by others, without permission; (v) contains any personal identification, such as license plate numbers, last names (first names are permitted), e-mail addresses or street addresses for any person other than entrant, or otherwise infringes on the privacy of any person other than an entrant; (vi) communicates messages or images inconsistent with the positive image and good will of Sponsor’s brand; and/or (vii) violates any law. Any Content Submissions that contain, depict or show such content; that exceed any required file size or length limits imposed by Sponsor or any third-party social media site; and/or that violate these requirements and/or the terms of these Official Rules will be disqualified. Sponsor reserves the right in their sole and unfettered discretion to disqualify any Content Submissions that they believe is inappropriate or not suitable for publication, that does not comply with these Official Rules, or that is not consistent with the spirit or theme of the Sweepstakes.
Free Alternative Method of Entry via Email:
You can alternatively enter by sending an email during the Entry Period with your first and last name, city/state of residence, email address, and phone number to: socialmedia@regiscorp.com. Include “Supercuts Stylist Appreciation Sweepstakes” in the email subject line. Entries may not be accepted if the email subject line is incorrect. You will receive one (1) entry per email. Limit three (3) entries per person regardless of method of entry. You can send emails with the same information to submit additional entries up to the stated limit.
Sponsor assumes no responsibility for lost, incomplete, or incorrect entries. All entries must be submitted and received by Sponsor during the Entry Period to be eligible for the drawing. All entries become the property of the Sponsor and will not be returned or acknowledged.
ENTRIES RECEIVED FROM ANY PERSON OR ACCOUNT EXCEEDING THE STATED LIMITS WILL BE VOID. Proof of submission does not constitute proof of receipt by Sponsor. Automated entries, entries which use or in any way incorporate artificial intelligence or any other simulation of human intelligence or process through the use of a machine or computer system (collectively, “Artificial Intelligence”), either in the creation or submission of the entry or as a part of any entry, and/or third-party entries are prohibited. Any entry that was created by using, or in any way incorporates, Artificial Intelligence, or that was created or made by a third party, will be void, and the Entrant who submitted such an entry may be disqualified at Sponsor’s sole discretion. Multiple Entrants are not permitted to share the same email address. Any attempt by any Entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that Entrant’s entries, and that Entrant may be disqualified at Sponsor’s discretion. Normal Internet, phone and usage charges imposed by your online or phone service may apply. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected or illegible entries; lost, interrupted or unavailable network, server or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address used to enter will be deemed to be the Entrant or participant. The "authorized account holder" is defined as the natural person to whom the email address assigned by an internet service provider, online service provider, carrier, mobile phone provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning the email addresses for the domain associated with the submitted email address. Entries specifying an invalid, non-working or inactive email address will be disqualified and ineligible to win.
By submitting an Entry, Entrant explicitly acknowledges and agrees that the Sponsor and its legal representatives, successors and assigns shall have the irrevocable, worldwide right in perpetuity to license, sub-license, edit, alter, post, reproduce, publicly display and publish, in any media, including online, any or all material which you upload to any websites (including, without limitation, social media sites) associated with the Sweepstakes, with or without first and/or last name credit to the Entrant without any additional consideration or approvals from or to Entrant; and submissions that attempt to restrict this right will not be considered. Entrant warrants and represents that their submission is original, has not been previously published or won any award, complies with any applicable community guidelines, terms of use, and any other binding terms on Facebook, Instagram, or TikTok, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, complies with these Official Rules, and will not violate any federal, state or local laws or ordinances.
RANDOM DRAWINGS & ODDS: Five (5) potential winners will be selected in a random drawing held within 48 hours of the close of the Entry Period. Odds of winning depend on the number of eligible entries received. Once the potential winners are selected, they are no longer eligible to win another Sweepstakes prize.
WINNER NOTIFICATION: Potential winners will be notified via social media which may include but not limited to, by private or direct message or by email. Sponsor is not responsible for potential winner's failure to review notifications in timely fashion or failure to receive notice of winning.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. If there is a dispute as to the identity of an Entrant selected as a winner, the prize will be awarded to the authorized account holder of the email address or the email address associated with the subject social media account.
Potential winners may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, publicity release within three (3) days of date of issuance. If such documents are not returned within the specified time period and in the manner in which Sponsor dictates, if Sponsor is unable to contact a potential winner, if a potential winner does not respond to notification of winning within the specified time frame, or if a potential winner is not in compliance with these Official Rules, any prize will be forfeited and, at Sponsor’s sole discretion, an alternate winner may be selected by drawing at random from all remaining eligible entries received. Prize awards are subject to verification of eligibility and validation of compliance with these Official Rules. A maximum of one prize can be awarded to a person. No more than the number of prizes stated herein will be awarded.
PRIZES: Five (5) prizes in total will be awarded with a minimum total approximate retail value (“ARV”) of $500 and a maximum ARV of $1,750. The Total ARV for the Sweepstakes will depend on prize availability and prize selection by winners. Each winner will receive one (1) prize of their choosing from the curated list noted below subject to these Official Rules.
POTENTIAL PRIZES (SUBJECT TO AVAILABILITY THROUGH COSMOPROF):
Winners will be able to select one (1) of the following products to be awarded to them. The order of the prize selection will be determined by vendor availability at the time the prize is awarded. Prizes are subject to availability and once any of the below listed prizes are unavailable, winners may only choose from the remaining available prizes:

BaByliss Pro Nano Titanium Blow Dryer with an ARV of $100-$150.
BaByliss Pro FXOne Series (Clipper, Trimmer, Shaver Combo) with an ARV of $350.

PRIZE RESTRICTIONS: Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Prizes are not transferable or redeemable for cash or greater value. Sponsor reserves the right, in its sole discretion, to substitute prizes (or portions thereof) with one of comparable value. All federal, state, and local taxes, if any, as well as any other costs and expenses associated with the acceptance and use of prizes not specified herein are the sole responsibility of the respective winner. All prize details are in Sponsor’s sole discretion. Unclaimed prizes will not be awarded.
Any and all applicable federal, state and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of winner. Prizes cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its discretion. Sponsor will not replace any lost or stolen prizes. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Sponsor is not responsible for any delay or cancellation of the prize delivery due to unforeseen circumstances or those outside of their control. If the fulfilling merchant cancels the order for reasons out of Sponsor’s control, the prize will not be delivered and no additional compensation will be provided.
GENERAL CONDITIONS: In the event there is a discrepancy or inconsistency between disclosures or other statements (in any media) contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. In the event that there is a conflict between any agreement between an Entrant and Sponsor or franchise of Sponsor, the Official Rules shall prevail, govern and control.
Released Parties (defined below) are not responsible for any incorrect or inaccurate information, whether caused by any equipment or programming associated with or utilized in the Sweepstakes or otherwise. Persons who tamper with or abuse any aspect of the Sweepstakes or who are otherwise in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and any associated entries will be void. Should any portion of the Sweepstakes be unable to run as planned for any reason, including if, in Sponsor’s sole opinion, the Sweepstakes is compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right in its sole discretion to suspend, modify, or terminate the Sweepstakes and, if terminated, select the potential winners from all eligible, non-suspect entries received for the Sweepstakes prior to the action taken.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify any individual it finds to be attempting to tamper with or to undermine the entry process, any website associated with the Sweepstakes, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
PRIVACY: Personal information that Entrants provide in connection with the Sweepstakes which may be collected by the Sponsor are subject to Sponsor's privacy policy, available at https://www.regiscorp.com/privacy-policy.
LIMITATION OF LIABILITY: BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES TO RELEASE, INDEMNIFY, DEFEND AND HOLD HARMLESS SPONSOR AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (THE “RELEASED PARTIES”), AND THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE, ENTRY OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES-RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, PANDEMICS, EPIDEMICS, WIDESPREAD ILLNESS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE.
PUBLICITY AND INTELLECTUAL PROPERTY RELEASE: EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES WINNER’S PERMISSION AND GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) AND ITS DESIGNEES THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING, BUT NOT LIMITED TO, THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE WINNER’S ENTRY, NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING, BUT NOT LIMITED TO, HOMETOWN AND STATE), PRIZE INFORMATION, QUOTES ATTRIBUTABLE TO WINNER, AND ANY OTHER ELEMENTS OF ENTRANT’S PERSONA FOR ADVERTISING, TRADE AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION OR NOTIFICATION, INCLUDING IN A LIST TO BE USED BY SPONSOR AND ITS DESIGNEES AND ITS PARTNERS TO RE-TARGET ENTRANTS VIA EMAIL OR ANY SPONSOR APP, UNLESS PROHIBITED BY LAW.
WITHOUT LIMITING THE FOREGOING, AND EXCEPT FOR ANY MANUFACTURER’S WARRANTIES THAT MAY BE PROVIDED WITH INDIVIDUAL PRIZES, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES AND ALL PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. ENTRANT REPRESENTS AND WARRANTS THAT ENTRANT WILL INFORM THE APPLICABLE CUSTOMER(S) ASSOCIATED WITH THIS SWEEPSTAKES THAT SPONSOR MAY CONTACT CUSTOMER(S) REGARDING THE SWEEPSTAKES, INCLUDING WITHOUT LIMITING TO OBTAINING THE CUSTOMER(S) AGREEMENT FOR SPONSOR TO REPOST, SHARE, OR SHARE SOCIAL MEDIA ENTRIES AS DESCRIBED ABOVE.
MANDATORY ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THESE ARBITRATION AND CLASS ACTION WAIVER PROVISIONS CAREFULLY TO UNDERSTAND YOUR RIGHTS. EXCEPT WHERE PROHIBITED BY LAW, YOU AGREE THAT ANY CLAIM THAT YOU MAY HAVE IN THE FUTURE MUST BE RESOLVED THROUGH FINAL AND BINDING CONFIDENTIAL ARBITRATION. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY. THE RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS DISCOVERY OR THE RIGHT TO APPEAL, MAY BE MORE LIMITED OR MAY NOT EXIST. YOU AGREE THAT YOU MAY ONLY BRING A CLAIM IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF (LEAD OR OTHERWISE) OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU FURTHER AGREE THAT THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OR CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
THERE IS NO JUDGE OR JURY IN ARBITRATION, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED. HOWEVER, AN ARBITRATOR CAN AWARD ON AN INDIVIDUAL BASIS THE SAME DAMAGES AND RELIEF AS A COURT (INCLUDING INJUNCTIVE RELIEF, PUBLIC INJUNCTIVE RELIEF, DECLARATORY RELIEF, AND STATUTORY DAMAGES) AND MUST FOLLOW THESE TERMS AS A COURT WOULD.
If you have a complaint, dispute, or controversy, you agree to first contact us at [socialmedia@regiscorp.com] to attempt to resolve the dispute or controversy informally. You and Sponsor agree that we will resolve any disputes between us that cannot be resolved through such informal process or through negotiation within 120 days through binding and final arbitration instead of through court proceedings. You and Sponsor hereby waive any right to a jury trial of any Claim (defined below). All controversies, claims, counterclaims, and/or other disputes arising between you and Sponsor relating to these Official Rules, Sponsor’s Privacy Policy, any purchase you make from Sponsor, any communications between you and Sponsor (either directly or through a third party), and/or any aspect of our relationship with you (each a “Claim”) shall be submitted for binding arbitration in accordance with the Rules of the American Arbitration Association, Consumer Arbitration Rules (“AAA Rules”). The AAA’s Rules are available at www.adr.org or by calling 1-800-778-7879. The arbitrator shall be selected by agreement of the parties or, if the parties cannot agree, chosen in accordance with the Rules of the AAA. The arbitration will be heard and determined by a single arbitrator in the English language in [Minnesota], telephonically, or at a mutually agreed upon location in the United States. The arbitrator’s decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The arbitrator shall have the exclusive and sole authority to resolve any dispute relating to the interpretation, construction, validity, applicability, or enforceability of these Official Rules, or this arbitration provision, and any other terms incorporated by reference into these Official Rules. The arbitrator shall have the exclusive and sole authority to determine whether any dispute is arbitrable.
Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s Rules. In all other respects, the parties shall each pay their own additional fees, costs, and expenses, including, but not limited to, those for any attorneys, experts, documents, and witnesses. This arbitration agreement does not preclude you or Sponsor from seeking action by federal, state, or local government agencies. You and Sponsor also have the right to bring qualifying claims in small claims court. In addition, you and Sponsor retain the right to apply to any court of competent jurisdiction for provisional relief, including pre-arbitral attachments or preliminary injunctions, and any such request shall not be deemed incompatible with these Official Rules, nor a waiver of the right to have disputes submitted to arbitration as provided in these Official Rules.
The arbitrator shall follow the Federal Arbitration Act, 9 U.S.C. §§ 1-16, as amended. In all other respects, to the fullest extent permitted by law, the substantive law of the State of [Minnesota] shall apply, without regard to conflicts of laws principles.
Neither you nor Sponsor may act as a class representative or private attorney general, nor participate as a member of a class of claimants, with respect to any Claim. Claims may not be arbitrated on a class or representative basis. The arbitrator can decide only your and Sponsor’s individual Claims. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated.
If any provision of this section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this Section shall continue in full force and effect. No waiver of any provision of this section of the Official Rules will be effective or enforceable unless recorded in writing signed by the party waiving such a right or requirement. Such a waiver shall not waive or affect any other portion of the Official Rules.
If any claim or dispute is found by the arbitrator to be excluded from this arbitration agreement above, the parties agree that any such claim or dispute shall be exclusively brought in and decided by the state or federal courts located in [Minnesota].
This section of the Official Rules will survive the termination of your relationship with Sponsor.
30 DAY RIGHT TO OPT-OUT. YOU HAVE THE RIGHT TO OPT-OUT AND NOT BE BOUND BY THE ARBITRATION AND CLASS ACTION WAIVER PROVISIONS SET FORTH IN THIS SECTION OF THESE TERMS BY SENDING WRITTEN NOTICE OF YOUR DECISION TO OPT-OUT BY EMAILING US AT [socialmedia@regiscorp.com]. THE NOTICE MUST BE SENT WITHIN THIRTY (30) DAYS OF ACCEPTING THESE TERMS OR ENTERING THE SWEEPSTAKES, WHICHEVER IS EARLIER, OTHERWISE YOU SHALL BE BOUND TO ARBITRATE DISPUTES IN ACCORDANCE WITH THE TERMS OF THOSE SECTIONS. IF YOU OPT-OUT OF THESE ARBITRATION PROVISIONS, WE ALSO WILL NOT BE BOUND BY THEM.
SEVERABILITY: If any term or provision of these Official Rules is found under applicable law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed, and the remainder of these Official Rules shall continue in full force and effect.
