BY PARTICIPATING IN THIS SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE PARTICIPATING. WITHOUT LIMITATION, THIS CONTRACT PROVIDES FOR INDEMNIFICATION OF THE SPONSOR AND OTHER SWEEPSTAKES ENTITIES BY YOU, A CLASS ACTION AND JURY TRIAL WAIVER, A REQUIREMENT THAT MOST DISPUTES BE SETTLED BY MANDATORY BINDING ARBITRATION, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, META PLATFORMS, INC. (INCLUDING FACEBOOK AND INSTAGRAM), X CORP., TIK TOK, INC., OR ANY OTHER SOCIAL MEDIA PLATFORM OR THEIR PARENT COMPANIES.
1. SPONSOR: The Sponsor for this Sweepstakes is Regis Corporation (“Sponsor”), 3701 Wayzata Blvd. Suite 600, Minneapolis, MN 55416.
2. ELIGIBILITY: The Sweepstakes is open only to legal U.S. residents of the 50 U.S./D.C. who are 18 years of age (19 years of age in Alabama and Nebraska, 21 years of age in Mississippi) or older at the time of entry (each, an “Entrant”). Employees, officers, directors and agents of Sponsor, any other company involved in the presentation, administration or fulfillment of the Sweepstakes, and/or their respective subsidiaries, affiliated companies and divisions (collectively, the “Sweepstakes Entities”), and each of their immediate family members (defined as any spouse, partner, parent, legal guardian, sibling, child, legal ward, grandparent, or grandchild, regardless of where they reside) and/or those living in the same household are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.
3. HOW TO ENTER:
A. To enter by visiting Supercuts: Entrants who complete at least three (3) separate qualifying visits to any Supercuts location during the Sweepstakes Period will be automatically entered with one (1) entry into the Sweepstakes. To complete a qualifying visit, an Entrant (i) must visit any Supercuts within the 50 U.S. or D.C., (ii) must receive and pay for at least one (1) salon service, and, (iii) the service must be completed in connection with and recorded as associated with the Entrant’s Supercuts profile. If an Entrant does not have a Supercuts profile, they may create one for free at the time of purchase of their first Supercuts service, or online at https://www.supercuts.com/. Entrant must provide their email address or telephone number at the time of payment for a service to be associated with their Supercuts profile. Services which are purchased without association to Entrant’s Supercuts account cannot be retroactively connected to an account. Product purchases, gift card purchases, appointments that are canceled or not completed, and transactions that are fully refunded or otherwise invalidated do not qualify towards a qualifying visit.
Each Entrant is limited to one (1) qualifying visit per day, regardless of the number of services completed during the time of the visit. Multiple services provided during a single visit, or during a single day, shall count only as one (1) qualifying visit for purposes of this Sweepstakes.
Upon completing at least three (3) qualifying visits during the Sweepstakes Period, an Entrant will be automatically entered with one (1) entry into the Sweepstakes and, if selected as a potential winner, will be asked to review and agree to these Official Rules prior to verification and confirmation as a winner of the Sweepstakes. If you do not wish to participate in the Sweepstakes, you may contact Supercuts customer service at sweepstakes@regiscorp.com to request that your name be removed from the list of participating Sweepstakes Entrants.
B. To enter for free via email: Entrants may enter the Sweepstakes for free without visiting a Supercuts location and purchasing any Supercuts services by sending an email during the Sweepstakes Period to sweepstakes@regiscorp.com with the subject line “Supercuts Holiday Challenge Sweepstakes Entry.” Your email must include your full name, email address, telephone number, and 3 – 5 sentences explaining what you love about Supercuts and why you want to win this prize. Upon receipt by Sponsor of Entrant’s email with all required information, Entrant will be entered with one (1) entry into the Sweepstakes.
LIMIT ONE (1) ENTRY PER PERSON THROUGHOUT THE SWEEPSTAKES PERIOD, REGARDLESS OF METHOD OF ENTRY USED. ADDITIONAL ENTRIES IN EXCESS OF THE LIMIT MAY BE DISQUALIFIED. Automated entries, entries which use or in any way incorporate artificial intelligence or any other simulation of human intelligence or process through the use of a machine or computer system (collectively, “Artificial Intelligence”), either in the creation or submission of the entry or as a part of any entry, and/or third-party entries are prohibited. Any entry that was created by using, or in any way incorporates, Artificial Intelligence, or that was created or made by a third party, will be void, and the entrant who submitted such an entry may be disqualified at Sponsor’s sole discretion. Multiple entrants are not permitted to share the same email address or Supercuts account. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses, Supercuts accounts, or any other method will void all of that entrant’s entries, and that entrant may be disqualified at Sponsor’s discretion. Normal Internet, phone and usage charges imposed by your online or phone service may apply. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected or illegible entries; lost, interrupted or unavailable network, server or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant or participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working or inactive email address will be disqualified and ineligible to win.
4. SELECTION OF WINNERS: On or about February 5, 2027, Sponsor will select the name of potential winners of prizes in a random drawing from among all eligible entries received. The odds of winning are based on the number of eligible entries received. The potential winners will be notified on or about February 5, 2027, via the email address provided at the time of entry.
Except where legally prohibited, each potential winner must sign and return, within seven (7) days of being notified, a Declaration of Eligibility, Liability & Publicity Release (“Declaration”) and indicate potential winner has read and agrees to these Official Rules in order to claim their prize. If a potential winner cannot be contacted via email after the first attempt to contact them, or if they fail to review and agree to these Official Rules and sign and return the Declaration of Eligibility, Liability & Publicity Release, or any other documentation that Sponsor may require within the required time period, if potential winner is unable or unavailable to claim their prize within any time period specified by Sponsor, or in the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. If Sponsor is unable to determine and verify a potential winner after repeated alternate drawings or if they fail to receive a sufficient number of entries to correspond to the number of prizes available to be awarded, Sponsor reserves the right to not award any or all of the prizes.
Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
5. PRIZES: Ten (10) prize winners will each win one (1) prize. Each prize consists of one (1) $400 Supercuts gift card, which may be redeemed in store at any Supercuts location within the 50 U.S. or D.C. Approximate Retail Value (“ARV”) of each Prize: $400. Total ARV of all prizes to be awarded: $4,000.00. Limit one (1) prize per person.
PRIZE RESTRICTIONS: Additional terms may apply to the gift card, and will be provided with the gift card at the time of prize award. Any and all applicable federal, state and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of winner. Prize cannot be substituted, assigned, transferred or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at their discretion. Sponsor will not replace any lost or stolen prizes. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Sponsor is not responsible for any delay or cancellation of the prize delivery due to unforeseen circumstances or those outside of their control. If the fulfilling merchant cancels the order for reasons out of Sponsor’s control, the prize will not be delivered and no additional compensation will be provided.
6. GENERAL CONDITIONS: Sweepstakes participation constitutes Entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. In the event there is a discrepancy or inconsistency between disclosures or other statements (in any and/or all media) contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify any individual it finds to be attempting to tamper with or to undermine the entry process, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Sponsor and its agents are not responsible for (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error that may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor. If, for any reason, the Sweepstakes cannot be run as planned, Sponsor may disqualify any suspect entries and (a) suspend the Sweepstakes and modify the Sweepstakes to address the impairment, then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (b) terminate the Sweepstakes and award the prizes at random from among the eligible, non-suspect entries received up to the time of the impairment.
7. LIMITATION OF LIABILITY AND RELEASES: BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES TO RELEASE, INDEMNIFY, DEFEND AND HOLD HARMLESS SWEEPSTAKES ENTITIES, META PLATFORMS, INC. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, PANDEMICS, EPIDEMICS, WIDESPREAD ILLNESS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE.
8. PUBLICITY AND INTELLECTUAL PROPERTY RELEASE: EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES WINNER’S PERMISSION AND GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) AND ITS DESIGNEES THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING, BUT NOT LIMITED TO, THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE WINNER’S ENTRY, NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING, BUT NOT LIMITED TO, HOMETOWN AND STATE), PRIZE INFORMATION, QUOTES ATTRIBUTABLE TO WINNER, AND ANY OTHER ELEMENTS OF ENTRANT’S PERSONA FOR ADVERTISING, TRADE AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION OR NOTIFICATION, INCLUDING IN A LIST TO BE USED BY SPONSOR AND ITS DESIGNEES AND ITS PARTNERS TO RE-TARGET ENTRANTS VIA EMAIL OR ANY SPONSOR APP, UNLESS PROHIBITED BY LAW.
WITHOUT LIMITING THE FOREGOING, AND EXCEPT FOR ANY MANUFACTURER’S WARRANTIES THAT MAY BE PROVIDED WITH INDIVIDDUAL PRIZES, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING EACH WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES AND ALL PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
9. GOVERNING LAW. Except as otherwise provided herein, these Official Rules, your participation in the Sweepstakes shall be governed by and construed in accordance with the internal laws of the State of Minnesota without giving effect to any choice or conflict of law provision or rule. Should any claim proceed to litigation in a court of law or be otherwise exempted or excluded from the Arbitration Agreement herein, you agree that the only proper jurisdiction and venue for any dispute arising under these Official Rules, or related to this Sweepstakes, is in the state and federal courts in the State of Minnesota, U.S.A. You further agree and consent to the exercise of personal jurisdiction in these courts in connection with any dispute involving Sponsor or its parent company, employees, officers, directors, agents and providers.
10. ARBITRATION AGREEMENT. PLEASE READ THIS SECTION CAREFULLY. IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND HAVE A JURY HEAR YOUR CLAIMS. IT CONTAINS PROCEDURES FOR MANDATORY BINDING ARBITRATION AND A CLASS ACTION WAIVER.
a. ANY DISPUTE OR CLAIM ARISING OUT OF OR RELATING IN ANY WAY TO THE SWEEPSTAKES SHALL BE RESOLVED EXCLUSIVELY BY MANDATORY, BINDING ARBITRATION, ON AN INDIVIDUAL BASIS ONLY, RATHER THAN IN COURT, EXCEPT THAT YOU MAY ASSERT CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY. THE FEDERAL ARBITRATION ACT AND FEDERAL ARBITRATION LAW APPLY TO THIS ARBITRATION PROVISION.
b. Mandatory Pre-Suit/Pre-Arbitration Notice of Claim. Before seeking legal recourse of any kind for any harm you believe you have suffered arising from or relating to these Official Rules or the Sweepstakes, you agree to inform us in writing and to give us thirty (30) days to cure any alleged harm before initiating any arbitration or action excluded from the arbitration provision, as set forth herein. If we are unable to reach a resolution within thirty (30) days, you may pursue legal action as set forth in this Section.
c. Mandatory Binding Individual Only Arbitration. Except as expressly provided in this section, you agree that any dispute, claim, case, or controversy (whether based in tort (including negligence, gross negligence, fraud, intentional/negligent misrepresentation, and/or willful or knowing misconduct), contract, statute, regulation, ordinance, equity, or any other legal theory) between you and Sponsor, including its parent company, affiliates, officers, directors, service and marketing partners, parents companies, subsidiaries, agents, successors, assigns, employees, and franchisees, whether arising out of or relating to past, present, or future acts or omissions and including but not limited to, disputes in any way related to these Official Rules or the Sweepstakes (“Claims”) shall be exclusively resolved by mandatory and binding arbitration on an individual basis, rather than in court (“Arbitration Agreement”).
d. What is Arbitration? Arbitration is more informal than a lawsuit in court and seeks to resolve disputes more quickly. Instead of a judge or a jury, the case will be decided by a neutral arbitrator who has the power to award the same damages and relief that a court can.
e. Severance. If any provision of this Arbitration Agreement is found unenforceable, the unenforceable provision shall be severed, and the remaining arbitration terms shall be enforced.
f. WAIVER OF CLASS ACTIONS. YOU AGREE THAT, TO THE FULLEST EXTENT PERMISSIBLE BY FEDERAL, STATE, OR LOCAL LAWS, YOU MAY ONLY RESOLVE DISPUTES WITH SPONSOR ON AN INDIVIDUAL BASIS, AND MAY NOT BRING A CLAIM AS A PLAINTIFF OR A CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed. You expressly agree that you will not participate in any class, mass, collective, consolidated, private attorney general, or other representative arbitration proceeding. You agree that the arbitrator has no authority to arbitrate Claims on a class-wide basis and shall not consolidate, combine, or jointly arbitrate Claims of more than one (1) person in a single arbitration, unless otherwise agreed to by Sponsor in its sole and absolute discretion.
g. WAIVER OF JURY TRIAL. YOU AND SPONSOR HEREBY WAIVE YOUR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY, INSTEAD ELECTING THAT ALL CLAIMS AND DISPUTES SHALL BE RESOLVED BY ARBITRATION. ARBITRATION PROCEDURES ARE TYPICALLY MORE LIMITED, MORE EFFICIENT AND LESS COSTLY THAN RULES APPLICABLE IN COURT AND ARE SUBJECT TO VERY LIMITED REVIEW BY A COURT. IN THE EVENT ANY LITIGATION SHOULD ARISE BETWEEN YOU AND SPONSOR IN ANY STATE OR FEDERAL COURT IN A SUIT TO VACATE OR ENFORCE AN ARBITRATION AWARD OR OTHERWISE, YOU AND SPONSOR WAIVE ALL RIGHTS TO A JURY TRIAL, INSTEAD ELECTING THAT THE DISPUTE BE RESOLVED BY A JUDGE. YOU ACKNOWLEDGE THAT YOU HAVE BEEN ADVISED THAT YOU MAY CONSULT WITH AN ATTORNEY IN DECIDING TO ACCEPT THIS AGREEMENT TO ARBITRATE.
h. Claims Not Subject to Arbitration. There are only four (4) exceptions to this Arbitration Agreement:
i. Small Claims. Either party may bring individual Claims in small claims court.
ii. Personal Injury Claims. Both parties must litigate personal injury Claims in court. For purposes of this exception, personal injury Claims are claims arising from injury to the physical structure of the human body.
iii. Emergency Equitable Relief. Either party may seek temporary injunctive relief or other equitable relief in court pending arbitration. A request for interim measures will not be deemed a waiver of any other rights or obligations under this Arbitration Agreement.
iv. Intellectual Property Rights. To the extent you have in any manner violated or threatened to violate Sponsor’s intellectual property rights (for example, trademark, trade secret, copyright, or patent rights), Sponsor may bring a lawsuit for injunctive relief to stop unauthorized use or abuse of the Site, or intellectual property infringement (for example, trademark, trade secret, copyright, or patent rights) without first engaging in arbitration.
i. Statute of Limitations. You must initiate any arbitration (or an action excluded from arbitration) within one (1) year after the Claim has arisen or you will be barred from pursuing any cause of action.
j. Arbitration Procedures. Either party may initiate an arbitration proceeding, which will be conducted by a single neutral arbitrator. The Federal Arbitration Act governs the interpretation and enforcement of the Arbitration Agreement. Arbitration shall be initiated through JAMS. Any dispute, controversy, or claim arising out of or relating to these Terms shall be referred to and finally determined by arbitration in accordance with the JAMS Streamlined Arbitration Rules and Procedures. If there is a conflict between JAMS Rules and the rules set forth in this Arbitration Agreement, the rules set forth in this Arbitration Agreement will govern. The JAMS Rules and instructions for how to initiate an arbitration are available from JAMS at http://www.jamsadr.com or 1-800-352-5267.
k. To initiate arbitration, you or Sponsor must do the following things:
i. (1) Write a demand for Arbitration. The demand must include a description of the Claim and the amount of damages sought to be recovered. You can find a copy of a Demand for Arbitration at http://www.jamsadr.com.
ii. (2) Send three copies of the Demand for Arbitration, plus the appropriate filing fee to your local JAMS office or to JAMS, Two Embarcadero Center, Suite 1500, San Francisco, CA 94111.
iii. (3) Send one copy of the Demand for Arbitration to the other party.
l. Arbitration Fees and Costs. Payment of all filing, administration and arbitrator fees will be governed by the JAMS Rules, except that for claims of less than $1,000, you will be obligated to pay $25 and Sponsor will pay all other administrative costs and fees. In addition, for claims of less than $1,000, Sponsor will reimburse you for the $25 fee if the arbitrator rules in your favor.
m. Place of Arbitration. Arbitration under this agreement shall be held in either Minneapolis, MN, Chicago, IL, New York City, NY, Los Angeles, CA, Atlanta, GA or Dallas, TX (whichever is closest to your residence), or any other location we mutually agree to. Your access to the arbitration will not be precluded by the location of the arbitration.
n. Governing Law. This Arbitration Agreement is governed by the Federal Arbitration Act and federal arbitration law, and the laws of the State of Minnesota.
o. Arbitrator’s Authority and Award. The arbitrator will decide the rights and liabilities, if any, of the parties, and the dispute will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator will have the authority to grant motions dispositive of all or part of any Claim. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have, including the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable federal, state, or local laws, the Arbitration Rules, and this Arbitration Agreement. The arbitrator will issue a written award and reasoned statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. Any judgment or award rendered by the arbitrator may be subject to judicial confirmation and may be entered in any court of competent jurisdiction.
p. Right to Counsel. Each party to an arbitration is entitled to be represented in the arbitration by counsel of their choosing. Each party is solely responsible for their own attorneys' fees unless otherwise provided for by federal, state, or local laws, the Arbitration Rules, this Arbitration Agreement, or the arbitrator's award.
q. Confidentiality. All aspects of the arbitration proceeding, including but not limited to, the award of the arbitrator and compliance therewith, will be strictly confidential. The parties agree to maintain confidentiality unless otherwise required by law. This paragraph will not prevent a party from submitting to a court of law any information necessary to enforce this Arbitration Agreement or to enforce an arbitration award.
11. SEVERABILITY: If any term or provision of these Official Rules is found under the law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed, and the remainder of these Official Rules shall continue in full force and effect.
12. PRIVACY: Information collected from Entrants is subject to the Sponsor’s Privacy Policy, which can be found at https://www.regiscorp.com/privacy-policy. Entrants agree that Sponsor and Sponsor’s agents, affiliates, subsidiaries, representatives or service providers may use Entrants’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor thinks may be of interest.
13. OFFICIAL RULES AND WINNERS LIST: For a copy of the Official Rules or for a list of winners available after winners have been confirmed, email Sweepstakes@regiscorp.com. Requests for winners must be received no later than 6 months after the end of the Sweepstakes Period.
